1. Acceptance of Terms
By accessing or using any MyTurn Health platform (MyTurn Pharma-OS, MyTurn Clinic, MyTurn PMS, MyTurn Academy, MyTurn Pay, MyTurn Financing, MyTurn Data, MyTurn Pharma, MyTurnDrugApp, or the Customer Portal), you agree to be bound by these Terms of Service.
2. Eligibility
- Pharmacies: Must hold a valid Pharmacy Council of Nigeria (PCN) premises license
- Doctor Clinics: Practicing physicians must hold a valid MDCN registration
- Hospitals: Must be registered with the Federal Ministry of Health
- Wholesale Customers: Must hold valid CAC registration and PCN wholesale license
- Patients (MyTurnDrugApp): Must be 18 years or older
3. Services
MyTurn Health provides:
- B2B pharmaceutical wholesale ordering and distribution
- Pharmacy management system (POS, inventory, labels, compliance)
- Electronic medical records and e-prescribing (FHIR-compliant)
- Drug verification for patients (Tri-State GS1 scanning)
- Payment settlement and credit services (CBN 2026 regulated)
- Pharmacist training and CPD certification (PCN-accredited)
4. Wholesale Ordering
Pricing: All prices are in Nigerian Naira (NGN). Tier-based discounts apply: Tier A (15%, Net 60), Tier B (10%, Net 30), Tier C (5%, Net 15), Tier D (0%, Cash). Prices may change without notice. Orders are binding once confirmed.
- Minimum order values apply per tier
- Delivery within 24 hours for metro areas (Lagos, Abuja, PH, Kano)
- Cold chain products shipped with IoT temperature monitoring
- Returns accepted within 14 days for damaged or short-dated products
5. Prescription Clearinghouse
- Single-Fill Guard: Each prescription can only be dispensed ONCE across the entire network
- Prescriptions expire 30 days after issuance
- Controlled substances (Schedule I-IV) follow NDLEA regulations
- All prescriptions require valid MDCN digital signature
6. Payment Terms
- Payments processed via Interswitch Autopay, NIBSS NIP, or bank transfer
- VAT of 7.5% applies to all transactions (FIRS compliant)
- Credit facilities subject to our pharmacy credit assessment
- Late payments may result in tier downgrade and credit limit reduction
7. Data Protection
All data handling is governed by our Privacy Policy and complies with the Nigeria Data Protection Act 2023, GAID 2025, and FCCPC DEON 2026.
8. Prohibited Activities
- Selling counterfeit, unregistered, or recalled medications
- Circumventing the Single-Fill Guard or FEFO expiry controls
- Dispensing controlled substances without proper NDLEA authorization
- Sharing login credentials or allowing unauthorized access
- Attempting to extract or scrape patient data
- Using the platform for money laundering or terrorism financing
9. Counterfeit Reporting SLA (NAFDAC)
When the MyTurnDrugApp tri-state verification returns a Red (Suspected Falsified) result, a report is auto-queued to the NAFDAC Post-Market Surveillance Directorate. We commit to the following service levels:
- Auto-queue to NAFDAC: within 60 seconds of the tri-state Red verdict
- Report acknowledgment from NAFDAC: target within 48 hours per NAFDAC Standard Operating Procedure for Counterfeit Reports
- NAFDAC investigation response: timeline set by NAFDAC; typically 7-21 days for non-critical, 24-72 hours for critical (e.g., alleged harm to patient)
- Patient notification: the reporting patient receives a NAFDAC reference number (format
MTDA-RPT-YYYYMMDD-NNNN) via the app within 5 minutes of the report firing
- Chain of custody: every counterfeit report writes an immutable audit row (SHA-256 hash chain) that NAFDAC can independently verify
We do NOT make any direct diagnostic or clinical claim on a Red verdict — we report the scan event to NAFDAC and let NAFDAC's regulatory process determine whether the product is falsified. Patients should retain the product + packaging and await NAFDAC's response.
NAFDAC's counterfeit reporting portal: nafdac.gov.ng/counterfeit-reporting. The MTDA-generated reference number is the same one visible to NAFDAC caseworkers.
10. Limitation of Liability
MyTurn Health is a technology platform facilitating pharmaceutical supply chain operations. We are not a pharmacy, clinic, or healthcare provider. Clinical decisions remain the responsibility of licensed practitioners. We are not liable for adverse drug reactions, misdiagnosis, or dispensing errors by partner pharmacies.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration in Lagos, Nigeria, under the Arbitration and Mediation Act 2023.
